Freedom of Information

Although LVRPA claims it is not subject to the Freedom of Information Act, it says it abides by it in practice. Mike Wells, who faced charges (subsequently dismissed) connected to an alleged incident on Porters Field during the construction of practice basketball courts for the Olympics, took advantage of LVRPA's voluntary FoI compliance and the following exchange took place.

Do any of the LVRPA's staff, or the staff of the LVRPA's
contractors, have the power of arrest in the Lee Valley Park?

By the power of arrest in this context I mean the power of arrest
beyond that of a citizen's arrest.

If any of the LVRPA's staff, or their contractors, do have the
power of arrest please outline in what circumstances they have this
power and in what geographic area they have this power.

Do any of the LVRPA's staff, the staff or their contractors, carry
a warrant card? If they please outline what powers the carrying of
this card give them?

of staff or contractors of LVRPA.

This has been passed to the Authority's Information Officer who will
respond to you by 5th August.

The Lee Valley Regional Park Authority is not covered by the Freedom of
Information Act but its Members have agreed to adopt the process. The
Authority looks at any request for information it receives to see if it is
able to supply the information in line with FOI requirements.

Re: Your Freedom of Information Request (Ref: CAS-02512-6CHMM1) concerning
powers of arrest vested in staff or contractors of the Lee Valley Regional
Park Authority.

I have set out the answers to your questions below.

1. Do any of the LVRPA's staff, or the staff of the LVRPA's contractors,
have the power of arrest in the Lee Valley Park? By the power of arrest
in this context I mean the power of arrest beyond that of a citizen's
arrest.

Yes, under section 31(2) of the Lee Valley Regional Park Act 1966
appointed officers of the Authority have the power of arrest.

2. If any of the LVRPA's staff, or their contractors, do have the power
of arrest please outline in what circumstances they have this power and in
what geographic area they have this power.

Section 31(2) states:

"Any officer of the Authority so appointed, any constable or any person
called to the assistance of such officer or constable may without other
warrant than this Act arrest any person committing or having committed any
offence against such byelaw whose name or residence is unknown to and
cannot be ascertained by any such officer or constable.

Provided that any such officer of the Authority acting under this section
shall have with him a written authority from the Authority to act and
shall produce the same as required".

The area in which these powers can be exercised is the area referred to as
"the Park" in the Authority's Byelaws. This means the Country Parks and
other recreational land set out in the Schedule defined by section 2 and
section 2(2) of the Lee Valley Regional Park Act 1966 and extended from
time to time by Section 23 of the same Act.

3. Do any of the LVRPA's staff, the staff or their contractors, carry a
warrant card? If so please outline what powers the carrying of this card
gives them.

Yes, the Authority's rangers carry warrant cards. The cards state that
"The above named Officer is appointed to the Authority and in pursuance of
this written authority may exercise all or any of the powers (including
power of arrest) conferred upon him/her by Section 31 of the Lee Valley
Regional Park Act 1966"

1966 and the Byelaws are available on the Authority's website.
