Will of Charles Brind of Wanborough April 11, 1736.

In the name of God Amen I Charles Brind of Wanborough in Wiltshire yeoman this eleventh day of April in the eighth year of the Reign of King George the Second And in the year of our Lord God One Thousand Seven hundred thirty and five (1735) Do make and declare this my last will and testament revoking all other wills by me heretofore made in manner and form following first I commit my soul into the hands of Almighty God and my body to be buried at the discretion of my executors here after named And as for my Real and Personal Estate I give and dispose thereof in manner and form following first I will that my funeral expenses and all debts which I owe in right or conscience to any person be fully satisfied contended and paid by my executor within convenient time next after my decease ALSO I give and bequeath the sum of forty shillings to be distributed among such poor persons of the Parish of Wanborough aforesaid and in propositions as my executor shall think fit within six months after my decease ALSO I give and devise unto Anne Brind (my daughter) of Wanborough aforesaid Widow All my messuage or dwelling house wherein I now dwell with the Barn stable backside orchard garden and close thereto belonging to hold the same from and presently after my decease for and during the term of her natural life If she shall live and remain a widow to be and unmarried And from and immediately after here decease of marriage which shall first happen I give and devise the same to John Brind (my son) for the term of his natural life The Remainder thereof to my Godson Charles Brind son of the said John my son and the heirs of his body lawfully issuing And for want of such heirs the Remainder thereof to John Brind (Brother of the said Charles my Godson) and his heirs lawfully issuing and for want of such heirs The Remainder thereof to John (thereof to John) Brind (my Grandson) son of the said Anne Brind my daughter his heirs and assigns for ever ALSO I give and devise unto the said Anne Brind my daughter one clear annuity of three pounds over and besides all taxes and deductions whatsoever to be paid to her yearly during her natural life by equal and quarterly payments and for securing the payment thereof I do hereby charge all my six acres of meadow ground lying in the nithe belonging to Wanborough aforesaid ALSO which is (gap) of William King I give and bequeath unto Mary my daughter the bed on which Margaret my grand daughter usually use to lie {scratched out "with all the bedding (something) belonging"} and my wife's trunk and in money only five shilling having already given her a reasonable fortune ALSO I give and bequeath unto Margaret (my granddaughter daughter of the said Anne my daughter twenty pound, in money to be paid unto her at one and twenty years of age or day of marriage which shall first happen with interest for the same after the Rate of four pounds by by the hundred by the year to be computed from the end of twelve months time next after my decease ALSO I give and bequeath unto my granddaughter Anne Brind daughter also of the said Anne Brind my daughter ten pounds in money the same to be paid unto her at one and twenty years of age or day of Marriage which shall first happen with interest for the same in manner as aforesaid ALSO I give and bequeath from and presently after my decease unto Charles Avenell (my Grandson) {scratched out} my best bed and all the bedding bedstead and furniture to the same belonging ALSO I give and bequeath unto John Brind (my Grandson) son of the said Anne my daughter twenty pounds in Money the same to be paid to him at one and twenty years of age with interest for the same in manner as aforesaid And if either or any of my {scratched out) Grand Children or legatees herein named shall happen to die before his heir or their legacy or legacies shall or doth become due and payable then the legacy or legacies of him her or them so dying shall equally be divided and paid to the living of them when his her or their own legacy or legacies shall and will become due and payable ALSO I give and devise unto the said John Brind (my said son) All and singular my messuage lands tenements and hereditament whatsoever not herein before already devised the said six acres of meadow subject nevertheless to the payment of the said annuity charges thereon as above said) to hold to him the said John Brind my son and his assigns for and during the term of his natural life without impeachment of waste and from and after his decease I give and devise all the same messuage lands and hereditament unto the said Charles Brind (my Godson) his son and to the heirs of his body lawfully issuing And for want of such heirs The remainder thereof unto John Brind (Brother of the said Charles Brind my God son and his heirs lawfully issuing and for want of such heirs the remainder thereof to John Brind my Grandson and son of the said Anne Brind my said daughter his heirs and assigns for ever ALSO I do hereby make constitute and ordain my son John Brind sole executor of this my will and to him I give dispose and bequeath all the residue of my moneys credits stock chattels and personal estate whatsoever not hereby otherwise dispose of (gap) paying all my debts funeral expenses and legacies as aforesaid and I do hereby nominate make and appoint my kinsman Edward Brind and James Stone of South Marston in Wiltshire aforesaid yeoman to be overseer of this my will to see the same duly performed and if any dispute shall arise touching the same my will is that if be determined by them or the survivor of them and to them the said Edward Brind and James Stone I give the sum of five shillings each And do declare this to be my last will and testament In Witness signed sealed published and declared by the said Charles Brind the testator as and for his last will and testament in the presence of us whose names (at his request and in his presence) are hereunto subscribed as witnesses to the same Note the Razure made betwixt the twentieth and one and twentieth lines and in the twenty eighth line were made before sealing hereof Thomas Thomas Charles Brind
