COURT OF ADMIRALTY-- Monday
(Before Mr Justice Channell, without a Jury) SAMUEL WILLIAMS AND SONS LTD V. KERR-- This was an action brought against Commander Mark Edward F. Kerr, R.N., to recover damages for the swamping and sinking of a barge belonging to the plaintiffs by reason of the alleged improper navigation and excessive speed of a flotilla of torpedo-boat destroyers under the command of the defendant. The damage to the barge and the amount of damages was not in dispute; but the defendant denied liability on the grounds (1) that the damage was not caused by the vessels under his command, and (2) that, even if it was, the vessels were not negligently or improperly navigated. The case for the plaintiffs was that their barge was properly moored on Saturday, May 12, 1900, alongside the wharf of the Cement Works, Northfleet, in the Thames; that on May 14, about 11.45 a.m., the torpedo flotilla went down the river at a speed of 15 miles an hour, creating a great swell , which caused the barge to bump heavily on the ground and founder. The speed of the flotilla, and the great swell it created, was deposed to by to witnesses for the plaintiffs, who saw the barge sink. For the defence Commander Kerr was called and said he was in command of the flotilla. The wind was N.E., very high, with rough water causing difficulty in navigating the destroyers. Ten knots was the lowest speed he cared to go on such a day. Owing to the continuous claims coming in he had not gone more than 10 knots in that reach for the last 18 months. Two independent witnesses were called for the defence to speak to the rough state of the weather, and the speed the destroyers were going at. Mr Justice Channell gave judgement for the defendant. |
Note: that means Kerr won so Williams did not get the money for his barge. |
