Henry Brind 1650-1722

In 1674 Henry married Elizabeth Wilde at Lydiard Tregoze (NW of Swindon). The Highworth Parish registers show that he was an Innholder and that they had the following family. Elizabeth died in 1691 while giving birth to William. Henry must have remarried because a second wife also named Elizabeth was mentioned in his will and died in 1741.

During Henry's life Highworth suffered from smallpox and influenza from 1670-79, epidemics also occurred in 1685, 1695 and 1699.

It is interesting to see how his friends, the Colemans, remain linked with the family in the next two sections.

Henry appears to have played a full part in the life of Highworth - he was churchwarden in 1685 and 1721 when they had far more power than they do today. He was also Constable which was a most unpopular job. In 1693 he acquired the Malthouse and other property in Highworth.

From his will it can be seen that Henry died a wealthy man, probably better off than either of his two elder brothers as both families were left money. He should probably be added to our roll of honour as he undoubtedly raised the status of the family in Highworth.

According to the visitation and marriage allegations (licences) records of the Peculiars of the Dean and Chapter of Sarum, before becoming an Innholder Henry was a Cordwinder (I).

From the Probate documents in this section it is learnt that his wife was called Mary. In the Cirencester Church records a Mary Brind is shown as being married to Thomas Essington in 1720, therefore she probably remarried after Thomas's death.

Indenture from March 25, 1693, between William Herring (Hearing) of Highworth, Cordwainer, John Greene of Stratton St Margarett, Cordwainer, son of Ambrose Greene, maltster, (deceased) Henry Brind, Inn holder of Highworth, and Thomas Hippsly of Staunton, Highworth.

Ambrose Greene used to occupy the malthouse at Westrop, Highworth. In 1691 his son John Greene had contracted to lease the malthouse to William Herring for £64 10s over 500 years, with a peppercorn rent. There was a get out clause. Greene could pay Herring £1 18s 4d on the following June 24th and £65 18s 4d on December 22.

But the original £64 10s was not paid. Henry Brind steps into the picture paying £25 10s to Herring and £64 10s to Greene for a 500 year lease on the malthouse.

This indenture Quadripartite made the five and twentieth day of March in the fifth year of the Reign of our Sovereign Lord and Lady William and Mary by the grace of God of England Scotland France and Ireland King and Queen defender of the faith or Anno D.... 1693. BETIVECITE William Herring of Highworth in the County of Wilts Cordwainer of the first part John Greene of Stratton St Margarett's in the said County of Wilts Cordwainer eldest son of Ambrose Greene late of Westrop in the parish of Highworth aforesaid maltster deceased of the second part Henry Brind of Highworth aforesaid Innholder of the third part and Thomas Hippsly of Staunton in the parish of Highworth aforesaid gent of the fourth part. The price is 5s plus a peppercorn.
This indenture made the third day of April in the fifth year of the Reign of our Sovereign Lord and Lady William

Fellmonger hereafter doe make of cause to be made a true and perfect inventory of all and singular the goods and chattells and credits of the said deceased which have or shall come to the hands possion or knowledge of her the said Mary Brind--- or into the hands and possession of any person or persons for her and the same so made do exhibit or cause to be exhibited into the Registry of Glous --- at or before the last --- day of November next ensuing And the said goods chattells and credits and all other the goods chattells and credits of the said deceased at the time of his death which at any time after shall come to the hands or possession of the said Mary Brind---- or into the hands and possession of any other person or persons for her doe well and truly administer according to law And further doe make or cause of be made a true and inft attempt of her acrou at or before ye last date of Septembe next and all the rest and residue of the said goods chattells and credits which shall be found remaining upon the said administrators attempt the same being first examined and allowed of by the judge or judges for the time being of the said court shall deliver and pay unto such persons or person respectively as the said judge or judges his his or their ... or sentence persuant to the ... intent and meaning of a late Act of Parliament made in the two and twentieth and three and twentieth years of the raigne of the said Soveraigne Lord King Charles and Second (Intituled An Act for the better settling of Intestates (estates) shall limit and appoint And if it shall hereafter appear that any last will and testament was made by the said deceased and the Executor or Excutors therein named doe exhibit the same into the said court making above request to have it allowed and approved accordingly if the said Mary Brind above bound being thrown required doe and deliver the said Lords of Adcon (approbation of such Testament being first had and made) in the said court thou this obligation to be void and of none effect or or else to remain in full force and virtue.

Will of Henry Brind of Highworth, December 26, 1722.

In the name of God Amen. I Henry Brind of Highworth in the County of Wilts, Innholder, being at this time in perfect memory (thanks be to my good God) but considering my age & the indisposition of my body & the frailty of human nature & being minded to make a settlement for my wife and children whilst I am in perfect memory make this my last will and testament in manner and form following. First I bequeath my soul into the hands of my good God and Creator, trusting through the merits of Jesus Christ my saviour that he will have mercy upon my soul, and my body to be buried at the discretion of my executors hereafter named. Item I give to my wife Elizabeth during her widowhood the sum of twenty pounds a year to be paid her half yearly out of the interest of two bonds of two hundred pounds each the one due from Roufe Freke* of Hannington Esq the other from Mr Anthony Goddard of Purdon & Mr Spencer of Malmsbury. Upon the marriage or decease of my said wife the said four hundred pounds to go to my grandson Henry Brind, son of William Brind. Item I give to my said wife Elizabeth all the stock I shall leave in my cellar and at my decease. Item I give to my said wife Elizabeth the use of all my household goods in my dwelling house at Highworth so long as she shall continue a widow; but upon her marriage or death to go to the children of my son William Brind. Item I give to my grandson Henry the son of William Brind the sum of one hundred pounds. Item I give to my grandson William the son of William Brind the sum of one hundred pounds. Item I give to my grandson Walter the son of William Brind the sum of one hundred pounds. Item I give to my grandson Henry the son of Thomas Brind my house at Cirencester in the County of Gloucester when he shall arrive at the age of twenty one years; but if he die before he arrive at that age then to the heirs of my son William Brind. Item I give to my said Grandson Henry the son of Thomas Brind the sum one hundred pounds to be paid him when he shall arrive at the age of twenty one years. Item I give to my grand daughter Mary the daughter of Thomas Brind the sum of one hundred pounds when she shall arrive at the age of twenty one years. Item I give to my grandson Henry the son of William Brind my house at Westrop in the Parish of Highworth now in the occupation of John Fuller. Item I give my largest silver tankard to my grandson Henry the son of William Brind, the next biggest to my grandson Henry the son of Thomas Brind, & the least to my grandson William the son of Will Brind.

Item if either of my grandsons Henry or William or Walter the sons of William Brind shall die before they arrive at the age of one and twenty years then what I have bequeathed them in this my last will and testament to be equally divided between the survivors. Item I give to my son William Brind the sum of one hundred and fifty pounds to be paid him within twelve months after my decease. And I likewise discharge him from all debts due from him to me. Item I give to my son Thomas Butcher the sum of twenty shillings and to his wife my daughter Elizabeth Butcher the sum of twenty pounds to be paid them within twelve months after my decease. Item I give to Mary the wife of my son William Brind the sum of twenty pounds to be paid her within twelve months after my decease. Item I give to my brother Thomas Brind the sum of ten pounds to be paid him at two equal payments within two years after my decease. Item I give to every son of my nephew John Brind twenty shillings each. All the rest of my goods chattels & debts not herein by me bequeathed I give to be divided between all the children of my son William Brind. But if it should so happen that he should have any more children than what are mentioned in this my last will & testament I desire that they may have a larger share than those already herein provided for which I leave for the discretion of my executors. Item I make my said wife Elizabeth & my said son William Brind joint executors in trust for my said Grandchildren herein before mentioned & executors of this my last will and testament. Lastly I constitute & appoint the Revd James Ayscough** Vicar of Highworth, Thomas Brunsden of Marlborough Draper & Thomas Coleman of High Chyruryson, Trustees & overseers of this my last will & testament & revoke all former wills. In this will whereof I have hereunto set my hand and seal this twenty sixth day of December in the ninth year of the reign of our sovereign Lord George by the Grace of God of Great Britain, France & Ireland, King Defender of the Faith &C Anno Domm 1722.
